博物馆法人制度是文博法治体系的重要组成部分,从法学理论与实定法相结合的视角探究博物馆法人制度的概貌,应该对博物馆实务有着积极的现实意义。文章从博物馆法人的设立原则、构成要件、类型划分、治理结构和责任形态五个方面对我国博物馆法人制度进行了跨学科、跨部门法层面上的分析,在适当参考国内外相关理论观点和立法实践的同时,指出我国博物馆法人制度需要在相关部门法体系建设和完善的历史进程中同步构建和实施。
The legal person system of museums is an important part of the system of law and order in the museum of literature and art. To explore the general situation of the legal person system of museums from the perspective of the combination of legal theory and practice law should have positive and practical significance for the practice of museums. Based on the interdisciplinary and cross-sectoral law, the article analyzes the legal system of museums in China from five aspects: the establishment principle, constitutional elements, classification, governance structure and responsibility forms of museums. With appropriate reference to domestic and foreign relevant theoretical opinions and legislation At the same time, it points out that the legal system of museums in our country needs to be constructed and implemented synchronously in the historical process of the construction and perfection of the legal system of relevant departments.
