协调个人权利与社会功利的冲突在当今社会显得尤为重要。这种调和既可以从理性人的视角切入,又可以从合理人的角度进行。前者通过理性人在公共领域的讨论、修正、辩护和调整所达成的共享正义观来实现;后者凭借合理人进行谈判所达成的利益平衡来完成。这两种调和方式相互补充。
It is particularly important in today’s society to coordinate the conflict between individual rights and social utility. This reconciliation can be both rational people’s point of view, but also from a reasonable perspective. The former is realized through the shared justice view reached by the rational people in discussions, amendments, justifications and adjustments in the public domain; the latter is accomplished by balancing the interests reached by the reasonable people in their negotiations. These two ways of reconciliation complement each other.
