20世纪比较法学研究取得了许多重要成果,但也存在着许多缺陷与不足,如理论上较为贫弱,方法论研究片面化,研究中存在“西方中心主义”倾向等,这些问题在我国比较法学研究中更为突出;而社会科学方法具有注重从社会角度看事情,注重逻辑判断,注重理论总结等特点,这些特点能够在一定程度上解决上述问题。基于此,文章指出要将社会科学方法运用到比较法学研究中,并进一步阐释了一些具体方法的运用。
Many important achievements have been made in comparative jurisprudence research in the 20th century, but there are still many shortcomings and deficiencies. For example, the theoretical weakness, the one-sided methodological research, and the “Western-centrism” tendency exist in the study. The research is more prominent; and the social science method has the characteristics of focusing on things from the social point of view, focusing on logical judgment, focusing on the theory summary, these characteristics can to some extent solve the above problems. Based on this, the article points out that it is necessary to apply social science methods to comparative law research and further explain the application of some specific methods.
