贸易秘密是有价值的商业财产。随着技术革命的兴起和计算机使用的增多,以及伴随而来的各种安全问题,立法者的注意力正转向制定一个更适当的普遍保护秘密资料特别是贸易秘密的法律体制。的确,鉴于牵涉到的问题截然不同,有理由把贸易秘密与其他种类的秘密资料如私人资料和政府秘密区别对待,贸易秘密应像其他商业财产如工厂、机器、资金一样,得到法律的同等保护。本文集中注意力于刑法对贸易秘密的保护。目前,英国的刑法几乎仅仅关注存储资料的物质,即诸如文件档案、计算机、磁盘、微芯片等有形财产,而不关注这些物质上储存的无形体,即资料。这并非主张一切资料都应当由刑法或者乃至民法予以保
Trade secrets are valuable commercial property. With the rise of the technological revolution and the increase in the use of computers and the accompanying security issues, legislators are turning their attention to the development of a more appropriate legal system that generally protects secret information, especially trade secrets. Indeed, in view of the very different issues involved, it is reasonable to distinguish between trade secrets and other types of classified information, such as private data and government secrets. Trade secrets should receive the same legal protection as other commercial properties such as factories, machinery and funds . This article focuses on the criminal law protection of trade secrets. At present, the criminal law in the United Kingdom focuses almost exclusively on the material used to store data, namely, tangible property such as file archives, computers, disks, microchips and so on, rather than on the invisible materials stored on these materials. This does not mean that all information should be protected by criminal law or even by civil law
