云南省高院将李昌奎改判为死缓之所以招致舆论炮轰,不仅因为其法律依据和政策依据不确定,还因为用以辩护判决的废死信念冲撞了主流民意。废死信念的学术支撑也十分脆弱,不具备说服公众或者与公众沟通的力量。无论对于刑事法学的意识形态,还是对于向废死目标逐渐靠拢的刑事政策,李昌奎案引发的舆论风暴都是一个严厉的警告。
