信访制度作为公民表达利益诉求,维护自身权利的一种方式,在社会主义法治日益完善的今天,逐渐陷入困境。本文从一个真实的案例出发,在法治视野中,反思案件办理过程中的法律适用,审视信访,分析信访制度缺陷,以期在法治框架内寻求新的解决方案。
As a way for citizens to express their interest demands and defend their own rights, the petition system is gradually getting into trouble when the socialist rule of law is getting more and more perfect. Starting from a real case, this article reflects on the application of law in the handling of cases, examines letters and visits and analyzes the defects of the system of letters and visits so as to seek for new solutions within the framework of the rule of law.
