沈家本主持的“清末修律运动”是我国法制近代化的肇始,在修律的过程中沈家本一面修订旧律,一面大量移植西方先进的法律与制度。形成了自己独特的法律移植思想。在某种程度上讲我国当前的法治建设仍然面临着与沈家本修律时同样的问题——法律移植及其本土化。沈家本的法律移植思想尤其是对待传统法律文化与西方法律文化的态度对我们的法治建设中如何对待法治本土资源有很大的启示。他形成的一系列的法律移植的原则与法律移植的方法对我们的法律移植工作都有很大的借鉴意义。
Shen Jiaben’s “Cultivation Movement in the Late Qing Dynasty” is the beginning of the modernization of China’s legal system. To some extent, the current construction of the rule of law in our country still faces the same problem as that of Shen Jiaben’s work - transplanting the law and its localization.
