生育保险是我国社会保险的重要组成部分之一,它关系到广大育龄女性的切身利益。我国于1994年出台了第一部统一的生育保险法规——《企业职工生育保险试行办法》,标志着我国生育保险制度实现了由企业保障向社会统筹的转变。但随着我国社会经济体制的改革与进步,原有的生育保险制度已不能适应现代社会发展的要求,在此环境下,《社会保险法》应运而生。本文对《社会保险法》与《试行办法》中关于生育保险制度内容进行了评析,对完善我国生育保险制度提出建议,以供参考。
Maternity insurance is one of the important components of social insurance in our country. It relates to the vital interests of the majority of women of childbearing age. In 1994, China promulgated the first unified maternity insurance law - the Trial Measures on Maternity Insurance for Workers and Workers of Enterprises, which symbolized that the maternity insurance system in our country has realized the transformation from enterprise security to social co-ordination. However, with the reform and progress of China’s social and economic system, the original maternity insurance system can no longer meet the requirements of the development of modern society. Under this circumstance, the “Social Insurance Law” came into being. This article reviews the contents of the maternity insurance system in the “Social Insurance Law” and the “Trial Measures”, and makes suggestions for improving the maternity insurance system in our country for reference.
