本文首先对网络视频侵权行为作出了法律上的界定,接着介绍了网络视频著作权侵权的构成要件和归责原则与免责事由,最后对现实情况下私人利益与公众利益如何协调问题进行深入思考,并对协调各种主体之间的利益问题提出了一些建议。
This paper first makes a legal definition of online video infringement, and then introduces the constitutional elements of the copyright infringement of network video and the principle of blame and liability, and finally, it makes an in-depth reflection on how to reconcile the private interests with the public interests in reality Some suggestions are put forward for coordinating the interests among various subjects.
