我国公共道路管理瑕疵致害责任性质上属于民事赔偿责任。案件审理中甄别道路管理者应考虑道路性质、公路等级、瑕疵性质、部门设置等多方面,在行政处罚权相对集中情形下应根据瑕疵所对应的管理职能履行主体确定。适用普通注意义务标准作为道路管理是否存在瑕疵的判断标准,同时兼顾督促管理勤勉与防止加重负担原则。在无直接证据的条件下,认定因果关系应发挥一定的司法能动性,结合间接证据、生活常识、逻辑推断等作出综合性判断。除法律有明确规定之外,道路管理者与其他侵权人之间的共同责任形态适用按份责任为宜,道路管理者承担责任后不宜享有追偿权。
China’s public road management flaw liability nature of the nature of civil liability. In the trial of cases, the road managers should consider the nature of the road, the grade of the road, the nature of the defects, the department setting, and so on. Except as expressly stipulated by law, the common responsibility forms between road managers and other infringers should be appropriately applied. According to the responsibilities, road managers should not enjoy the right of recovery.
