《侵权责任法》规定了医务人员对患者负有的告知义务包括一般告知义务和特殊告知义务;明确了违反告知义务所承担侵权责任的构成要件。医方为了避免承担违反告知义务的侵权责任,一方面应依法充分履行告知义务;另一方面应善于利用法律规定的免责事由,争取减轻或者免除承担责任。
The Tort Liability Law stipulates that the medical personnel’s obligation of informing the patients includes the general disclosure obligation and the special disclosure obligation; and the explicit elements of the tort liability assumed in violation of the notification obligation. In order to avoid infringement of liability for violating the obligation of informing, the medical party should, on the one hand, fully perform its obligation of informing on the basis of the law; on the other hand, it should be good at using the exemption stipulated by law and alleviating or exempting it from liability.
