监察机关根据检查、调查结果,以监察文书的形式依法提出监察建议或作出监察决定,是依法履行《行政监察法》及其实施条例赋予职权的重要手段。规范使用监察文书,是落实中央纪委“三转”精神的具体举措,不仅能促进依法监察、增强监督实效,而且能有效避免行政复议及行政诉讼案件的发生。监察文书的使用与管理现状《行政监察法》明确规定了监察建议、监察决定等监察文书的适用情形、启用程序、法律救济等使用与管理的内容。为规范文书格式,监察部于1999年印发《关于实行监察文书格式标准文本的通知》,中央纪委监察部2000年制
