不可否认,非公有制企业为经济发展创造了巨大的产值,做出了税收贡献。但非公有制企业“原始积累方式”的管理,不断激化劳资矛盾,迫使劳动者需要通过各种可用而又不违法的手段维护自身劳动权益,其中包括企业职工罢工这样一种“非常方式”。本文通过探讨非公有制经济中罢工权的确认问题,希望妥善解决当前大量存在的自发罢工,平衡劳资双方的合法权益。
Undeniably, non-public-owned enterprises have created tremendous output value for economic development and made tax contributions. However, the management of non-public-owned enterprises and “primitive accumulation methods” has intensified the conflicts between labor and capital and forced workers to safeguard their labor rights through various available and non-illegal means, including a “very modest” strike by enterprise workers ". Through the discussion of the confirmation of the right to strike in the non-public ownership economy, this article hopes to properly solve the current massive spontaneous strike and balance the legitimate rights and interests of both employers and employees.
