近几年来,教育行政管理纠纷在我国多有发生,但由于现实的种种原因,这类纠纷往往不能获得有效的解决。教育问题与我们的生活息息相关,获得有效的教育行政管理纠纷的解决机制对每个公民具有重要意义。本文主要将“特别权力关系”理论和“内部行政行为”作为出发点,探求二者与教育行政管理行为的内部联系,并结合法律规定,对教育行政管理纠纷的可诉性问题发表几点拙见。
In recent years, educational administrative management disputes have occurred in our country, but due to various reasons, such disputes often can not be effectively solved. The issue of education is closely linked to our life, and effective mechanisms for the resolution of educational administrative disputes are of great importance to every citizen. This paper mainly uses the theory of “special power relations” and “internal administrative behaviors” as the starting point to explore the internal relations between the two and educational administration behaviors. In connection with the law, the issue of litigation of educational administrative disputes is published A few humble opinion.
