强制医疗作为一种特殊性的社会防卫措施,旨在通过对精神病患者的人身限制性治疗以达到维护公众安全和精神病患者身体健康利益的目的。为充分尊重和保护精神病患者的人身权益,有效避免枉法裁判的产生,就必须加强对强制医疗案件的检察监督。本文从强制医疗的概念及特征、强制医疗案件执行监督的必要性、当前强制医疗案件执行监督的存在问题,以及完善强制医疗案件执行监督的建议等四个方面,对强制医疗案件的执行进行论述。
As a special social defense measure, compulsory medical treatment aims to achieve the purpose of safeguarding the public health and mental health benefits of the mentally ill through the restrictive treatment of the mentally ill. In order to fully respect and protect the personal rights and interests of the mentally ill and to effectively avoid the occurrence of perverse real justice, we must step up procuratorial supervision of compulsory medical cases. This article discusses the implementation of compulsory medical treatment from the following four aspects: the concept and characteristics of compulsory medical treatment, the necessity of enforcing medical supervision, the existing problems of enforcing medical supervision in compulsory cases and the suggestion on perfecting the supervision of compulsory medical cases. .
