当前我们的法治建设进程如何,走到了哪一个阶段,遇到了哪些困难,这需要我们学者以严谨的态度,理性分析。我国的法治国家的建设路径到今天已经很明晰的从由上而下推动的单一性路径转轨到由上而下与由下而上结合推动的复合型的道路上来,实现由党和政府的智慧向与普通民众的智慧及需要相结合的转变,实现由单一性的法向双相度的法转型。我国目前法治国家建设已经取得了较大成就,迈入了法治国家行列,但还处于从中低水平的法治向高水平法治国家前进之中。
