保险利益原则是保险法特有的基本原则,保险合同亦因此有别于一般合同法意义上的合同。对保险利益与保险合同之间的关系进行探讨有助于在实践中更好地发挥这一原则的作用。本文试通过保险利益的存在、转移、消灭等几个角度入手对这一问题进行探析。
The principle of insurance interests is the basic principle of insurance law. Therefore, the insurance contract is different from the contract in the sense of general contract law. A discussion of the relationship between insurance interests and insurance contracts helps to better play this principle in practice. This article attempts to analyze this issue through the existence, transfer and elimination of insurance interests.
