第1章:宪政权威的基本内容。宪政权威理念可细分为三个层面内容:(1)民主所产生的公意型权威,这种权威强调人与人是同一类人群,统治者之所以成为统治者,不过是因为他们与被统治者是同一类人,从而获得了被统治者的信任;(2)法治所产生的规则型权威,这种权威强调社会治理的合理性,促进规则之下的社会发展,并进而形成权威;(3)优化权力配置所产生的善政型权威,这种权威强调国家权力的有限性,以及国家和社会的和谐共治。
Chapter 1: The Essential Elements of Constitutional Authority. The concept of constitutional authority can be subdivided into three levels: (1) the public-owned authority produced by democracy, which emphasizes that people are the same people and that the rulers become rulers only because they are not Rulers are the same kind of person, thus gaining the trust of the ruled; (2) the rule-based authority produced by the rule of law, which emphasizes the rationality of social governance, promotes the social development under the rules, and then forms the authority; (3) optimize the allocation of power generated by the good governance-type authority, this authority emphasizes the limited power of the state, as well as the harmonious coexistence of state and society.
