1911年至1946年中国公布了一系列宪法性文件,美国宪政思想在此系列立法过程中不时闪现。尤其是美国宪政思想中的两大特色,即总统制和联邦制,在中国一时喧嚣。受传统文化观念、现实政治力量对比及各自不同的利益追求等因素的制约,总统制和联邦制在中国最终走向了没落,近代中国宪政也没能实现预期的目标。中国先贤们将宪政视为抑制权力滥用之统治方法,针对权力而设却又没有最初的权力去推动,这是近代中国宪政失败的主要原因之一。
From 1911 to 1946, China published a series of constitutional documents. The constitutional thought of the United States flashed from time to time in this series of legislative procedures. In particular, the two major characteristics of the constitutional government in the United States, that is, the presidential system and the federal system, are temporarily noisy in China. Constrained by traditional cultural concepts, the contrast between the actual political forces and the pursuit of different interests, the presidential system and federalism finally declined in China, and the constitutional government in modern China failed to achieve the desired goal. The Chinese sages viewed constitutional government as the dominant method of suppressing the abuse of power, but they did not have the initial power to promote it. This is one of the main reasons for the failure of constitutional government in modern China.
