我国传统林地管理法律制度形成于计划经济时期,已不适应市场经济条件下发展现代林业的要求,存在立法理念滞后、行政权配置不合理等问题,需要树立生态文明理念,提升林地管理法律制度在林业法制体系中的地位,构建新型权利义务关系,形成适应现代林业发展要求的法律制度体系。
