法院审判程序主要包括立案、审理、评议、制作并发放裁判文书等阶段,每一个组成部分工作的细致和到位以及之间的良好过渡都是取得高质量诉讼结果所必须。本文聚焦从评议得出裁判结果到制作裁判文书这一环节,重点考察裁判文书与评议结果之间的关系,首次提出裁判文书与评议笔录的匹配性这一概念,并从实践的角度,探明该领域实际存在的问题,对出现问题的原因作出一定的理论探讨,并进一步提出解决问题的办法。
The court trial procedure mainly includes the stages of filing, hearing, reviewing, making and issuing judgments, and the detailed, in place and good transition of each component work are all necessary for obtaining a high quality litigation result. This article focuses on the link from refereeing judgment to making referee paperwork, focusing on the relationship between the referee’s instrument and the result of the review, first presenting the concept of consistency between the referee’s instrument and the reviewing transcript, and from the practical point of view, The actual problems in this field make some theoretical discussions on the causes of the problems and further propose ways to solve the problems.
