WTO专家组判定成员方的贸易限制性措施是否违反GATT及其他WTO协议时必须采用“审查标准”。如何确定“审查标准”将对国际监管和国内立法主权之间的平衡产生重大影响。DSU第11条规定的“客观评估”比较模糊,在实践中面临多重困境。但是专家组可以借鉴保障措施案中有关“合理立法者”的定义,在个案中进一步细化“客观评估”标准。
The panel of WTO experts must adopt “review criteria” to determine whether the trade restrictive measures of its member party violate the GATT and other WTO agreements. How to identify “censorship standards ” will have a significant impact on the balance between international regulation and the sovereignty of domestic legislation. Article 11 of the DSU stipulates that “objective assessment ” is rather ambiguous and faces multiple dilemmas in practice. However, the expert group can draw on the definition of “reasonable legislator” in the safeguard measure and further refine the “objective assessment” standard in each case.
