我国法律方法教育刚刚起步,名称、内容、教材内容体系及课程设置等问题均需要深入探讨和研究。法律方法课程并非是一种操作性技能的传授,而是提供一种基本的法律思维方式,并且也包含了相应的合理性反思。法律方法、法律方法论、法学方法论并无截然的分野,关键在于我们是否能够基于本国的法律规范与法律体系去讲授法律方法或法律/学方法论。为了实现法律方法课程的教学目的,可以参考德国法学院的课程设计模式。
The education of legal method in our country has just started, and the problems such as name, content, teaching material system and course setting all need further discussion and research. Legal method course is not a teaching of operational skills, but to provide a basic way of thinking about the law, and also includes the appropriate reflection of the rationality. There is no clear distinction between legal method, legal method and jurisprudence methodology.
