立法因素对金融法实效的影响在对司法现实中金融法实效的实证研究的基础上,建立理论模型分析。立法者通过控制法的排他性、对称性和严整性决定了金融法的可实施性。研究表明,立法因素的改善是提高金融法实效的必要途径。
The Influence of Legislation on the Effectiveness of Financial Law Based on the empirical study of the effectiveness of financial law in judicial reality, this paper establishes the theoretical model analysis. By controlling the exclusion of law, the lawmaker determines the enforceability of financial law by its symmetry and integrity. The research shows that the improvement of legislation is the necessary way to improve the effectiveness of financial law.
