我国刑事证据在使用过程中出现了许多问题,本文针对刑讯逼供和证人出庭作证的问题,提出了确立沉默权、非法证据的排除规则、证人保护等建议。
There are many problems in the use of criminal evidence in our country. In view of the problem of confession by torture and testifying in court, this article puts forward the suggestion of establishing the right of silence, the rule of exclusion of illegal evidence and the protection of witnesses.
