【裁判要旨】对于注册商标没有正当理由连续三年停止使用的,商标局可以撤销该注册商标。商标的使用对注册商标来说具有极为重要的意义。商标的主要价值在于使用,商标知名度的积累亦在于商标的使用。商标的使用必须是商标法意义上的具有商标识别功能的使用,单纯的负面报道不属于商标法意义上的商标使用。
[Referee summary] If there is no valid reason for the registered trademark for three consecutive years, the Trademark Office may revoke the registered trademark. The use of the trademark is very important to the registered trademark. The main value of the trademark lies in its use. The accumulation of the trademark’s reputation also lies in the use of the trademark. The use of trademarks must be trademarked in the sense of trademark law. The simple negative reports do not belong to the trademark use in the sense of trademark law.
