核心提示:本文以建设工程相关招投标项目为例,对投诉主体资格认定、投诉人举证责任、行政监督部门投诉处理权限等几个典型问题进行了分析。招投标投诉处理是实施招投标监督的重要环节,但是在目前相关法律法规尚待完善之际,招投标投诉处理的过程中暴露出了越来越多的法律问题。
Core Tip: In this paper, construction projects related to bidding for example, the main body of the complaints identified the complainant’s burden of proof, administrative oversight authority complaints handling several typical issues were analyzed. Tendering and bidding complaints handling is an important part of the implementation of bidding supervision, but at the current relevant laws and regulations have yet to be perfected, the process of bidding and handling complaints exposed more and more legal issues.
