随着国内离婚率的提高,夫妻财产制度得到了广泛的关注,尤其是在《最高人民法院关于适用(中华人员共和国婚姻法)若干问题的解释(三)》出台以后。该政策的出台主要是为了完善与夫妻财产制度相关的法律规定,增加与时代经济发展的适应性,其对我国现行的夫妻财产制度造成了重大的影响。鉴于此,本文对基于婚姻法的角度解释我国夫妻财产制度新变化的分析具有重要的实际意义。
With the improvement of the divorce rate in China, the marital property system has received widespread attention, especially since the introduction of the Supreme People’s Court’s Interpretation on Several Issues Concerning the Application of the Marriage Law of the Republic of China (Part Three). The promulgation of this policy is mainly to perfect the legal provisions related to the property system of husband and wife and to increase its adaptability to the economic development of the times. It has had a significant impact on the current system of property in China. In view of this, this article is of great practical significance to explain the new changes of conjugal property system in our country from the perspective of marriage law.
