根据人事部《关于在事业单位试行人员聘用制度的意见》,事业单位聘用合同由聘用单位的法定代表人或者其委托人与受聘人员以书面形式订立,聘用合同必须具备下列条款:(一)聘用合同期限;(二)岗位及其职责要求;(三)岗位纪律;(四)岗位工作条件;(五)工资待遇;(六)聘用合同变更和终止的条件;(七)违反聘用合同的责任。经当事人协商一致,可以在聘用合同中约定试用期、培训和继续教育、知识产权保护、解聘提前通知时限等条款。
Pursuant to the Opinions of the Ministry of Personnel on Piloting Staff Employment System in Public Institutions, the employment contract of public institutions is concluded in written form by the legal representative of the employing unit or his client and the employed staff. The employment contract must have the following provisions: (1) The duration of the contract; (2) the post and its duties and requirements; (3) the post discipline; (4) the working conditions of the post; (5) the wages and salaries; (6) the conditions for the change and termination of the employment contract; . After the parties have reached consensus, the terms of the probationary period, training and continuing education, protection of intellectual property rights, time limit for dismissal of advance notice, etc. may be stipulated in the employment contract.
