政府对房地产市场进行宏观调控主要有行政、法律、经济三种手段,但在法制社会的大背景下,政府的各种活动都离不开法律的指导和约束。从理论上讲,政府对房地产市场的宏观调控的法律手段主要包括对以下几种法律制度的运用押计划和产业政策法律调控;税收法律调控;金融法律调控。因此政府可以从以下法律层面进行调控押加强相关调控主体在房地产市场宏观调控中的相互协调;完善有关调控主体的法律责任,确保调控措施得以贯彻施行;完善与房地产相关的税收法制,真正发挥税法在房地产市场上的宏观调控功能。
