党的十八届四中全会提出了一项重要改革部署,即检察机关完善对涉及公民人身、财产权益的行政强制措施实施司法监督制度。强制隔离戒毒作为一种行政强制措施,在较长时间内限制公民人身自由,应当作为检察机关司法监督的对象。对强制隔离戒毒实施检察监督有利于维护戒毒人员合法权益,保障强制隔离戒毒活动的合法性,维护强制隔离戒毒场所的稳定性,预防和减少职务犯罪的发生率。从可行性上来看,对强制隔离戒毒实施检察监督有法律依据、经验基础和介入空间。检察机关探索对行政强制措施实施司法监督制度的重点,应当是未进入复议或者诉讼程序的强制隔离戒毒决定和所有强制隔离戒毒决定的执行。
An important reform plan was put forward by the Fourth Plenary Session of the 18th CPC Central Committee, that is, the procuratorial organs have perfected the system of judicial supervision on administrative coercive measures involving the personal and property rights and interests of citizens. Compulsory isolation of drug treatment as an administrative coercive measure to limit citizens’ personal freedom for a long period of time should be the object of judicial supervision by procuratorial organs. Prosecutorial supervision of compulsory isolation and drug treatment is conducive to safeguarding the legitimate rights and interests of drug abusers, ensuring the legitimacy of compulsory drug isolation and treatment activities, maintaining the stability of compulsory drug isolation and treatment facilities, and preventing and reducing the incidence of job-related crimes. From the feasibility point of view, there are legal bases, experience bases and interventional space for procuratorial supervision of compulsory isolation and drug treatment. The procuratorial organs should explore the implementation of the system of judicial supervision of administrative coercive measures by focusing on the compulsory isolation of drug treatment decisions and the enforcement of all mandatory drug isolation decisions that have not been entered into the review or procedure.
