现行城乡二元地制存在巨大的外部利润,“小产权房”是农民分享土地非农收益的一种方式。中央政府缺乏将“小产权”纳入正式制度轨道的动力。农地上市流转和土地兼并非洪水猛兽,政府管控主义的制度设计往往与农民根据自身利益做出的现实选择相悖。农地上市流转是大势所趋。在中短期内,农地产权制度改革的大体方向只能是建立一种市场与法律共同调整的综合机制。地权改革同时须配合其他社会政治经济改革措施以满足或控制现实的各种利益诉求。应有条件地将“小产权”等民间创新需求逐步纳入正式的制度变迁轨道。
The current urban-rural dualistic system has enormous external profits. The “small property room” is a way for farmers to share the benefits of non-agricultural land. The central government lacks incentive to include “small property rights” into the formal system. The transfer of agricultural land and the merger of land are not scourges. The system design of government controlism often runs counter to the realistic choice made by peasants according to their own interests. Agricultural land circulation is the trend of the times. In the short to medium term, the general direction of reforming the system of property rights in rural land can only be to establish a comprehensive mechanism for the common adjustment of markets and laws. At the same time, land reform must cooperate with other social, political and economic reform measures to meet or control the reality of various interest demands. Should be conditional to “small property ” and other civil innovation needs gradually into the formal institutional change orbit.
