程式诉讼时期是裁判官通过司法活动发展罗马法的黄金时期。笔者通过分析古罗马程式诉讼中裁判官救济制度的权力创设和司法介入,探寻罗马法的法律内涵,并思考该制度对我国民事立法和司法实践的借鉴价值。
The period of procedural litigation is the prime time for the magistrates to develop Roman law through judicial activities. By analyzing the power creation and judicial intervention of the magistrate’s relief system in ancient Roman procedural litigation, the author explores the legal connotation of Roman law and ponders over the reference value of this system to civil legislation and judicial practice in our country.
