刑事领域中的正当防卫法律效果是行为人因不具有犯罪行为的不正当性从而不认定为是犯罪;民事领域中的正当防卫的法律效果是通过对致害行为的不法性的排除从而不承担侵权责任。该文通过与刑事领域中正当防卫的参照对比,从立法目的、价值位序、构成要件、责任方式四个方面论述民法上的正当防卫,希望对有关制度的理论研究有所助益。
The legal effect of due diligence in the criminal field is that the perpetrator is not considered as a criminal for not having the wrongfulness of the criminal act; the legal effect of the justifiable defense in the civil sphere is not borne by the exclusion of the illegality of the perpetration Tort Liability. By contrasting with the justifiable defense in the criminal field, this article discusses the justifiable defense in civil law from four aspects: the purpose of legislation, the order of value, the elements of constitution and the mode of responsibility, and hopes to be helpful to the theoretical research on the system.
