前不久,赵先生在装修自家住宅时,在承重墙上另开了一个门,物业公司发现后,对其处以500元罚款。当赵先生提出异议时,物业公司以“业主行为守则”有规定为由辩解,双方发生争执诉至法院。 法院经审理认为,物业公司不享有行政处罚权。我国《行政处罚法》第15条规定:“行政处罚由具有行政处罚权的行政机关在法定职权范围内实施”。而物业管理公司不是行政机关,也不符合《行政处罚法》规定的受行政机关委托可以实施行政处罚的组织,所以无权实施包括罚款在内的任何行政处罚行为,其无权对赵某进行罚款。
