【摘 要】
：
目前我国尚未出台规定国家豁免问题的成文立法,面对他国在我国法院被诉无法可依,并且在他国被诉时常用外交途径表明绝对豁免立场.由于诉讼结果有不确定性,因之可能无法有效保护我国国家及国民利益.基于国外国家豁免立法和司法实践、国际人权法律化和经济政治环境的变化,中国有必要制定国家豁免法,并循序渐进地制定具体可行的条文规定,必要时采用限制豁免原则以切实维护我国的长远国家利益.
