国家担负着保护公民合法权益的义务,但是国家的保护亦不可能无所不在,因此,当公力保护失灵的情况事实上出现时,国家基于“秩序”与“公正”两大法律价值的衡平,而确认受害方的正当防卫权,使其可以基于防卫之目的,私力来保护自己的合法权益。所以,我们应该对正当防卫有正确的认识,以便在现实生活中正确运用来维护自己的合法权益。
The state is under the obligation to protect the legitimate rights and interests of citizens. However, the protection of the state can not be omnipresent. Therefore, when the situation of failure to protect one’s power appears in fact, the state bases its two legal values of “order” and “fairness” , And confirm the injured party’s legitimate defense rights, so that it can protect its own legitimate rights and interests based on the purpose of defense.
