我国虽不是《汉堡规则》的参加国,但仍然将“实际承运人”概念引入我国《海商法》。此概念的引入解决了我国海运实践中的许多问题。但是由于这是个舶来概念,我国引入此制度时在立法技术上存在缺陷,使各学者在实际承运人含义的理解和法律条文的解释上存在诸多差异,并且导致实际运用的困难。作者在文中浅谈了自己对这一概念的理解以及对一些争议看法。
Although our country is not a participant in the “Hamburg Rules,” we still introduce the concept of “actual carrier” into China’s “maritime law.” The introduction of this concept has solved many problems in China’s maritime shipping practices. However, because it is a concept of ship, when introducing this system in our country, there are flaws in the legislation and technology, which make scholars have many differences in the understanding of the actual carrier and the interpretation of legal provisions, and lead to difficulties in practical application. The author briefly discusses his understanding of this concept and some controversial views.
