2001年 3月 23日,联合国国际贸易法委员会通过了《电子签字示范法》,该法是贸易法委员会通过的一系列电子商务国际文书中的又一重要文件。其立法的基本思路是:作为一项单独的法律文书;与《贸易法委员会电子商务示范法》完全一致;对《贸易法委员会电子商务示范法》第 7条详细说明;拟由技术条例及合同加以补充的“框架”规则;对电子签字法律效力增加确定性;规定有关各方的基本行为守则;不偏重任何技术的框架等。该法包括 12条,规定了《电子签字示范法》的适用范围、定义、签字技术的平等对待、符合签字的要求、签字人的行为、验征服务提供商的行为与可信赖性、依赖方的行为、对外国证书和电子签字的承认等。
On March 23, 2001, the United Nations Commission on International Trade Law adopted the Model Law on Electronic Signatures, which is yet another important document in a series of international e-commerce instruments adopted by UNCITRAL. The basic idea of its legislation is: as a separate legal instrument; fully consistent with the UNCITRAL Model Law on Electronic Commerce; elaborated on article 7 of the UNCITRAL Model Law on Electronic Commerce; to be covered by the technical regulations and the contract Supplementing the “framework” rule; adding certainty to the legal validity of electronic signatures; providing for a basic code of conduct for all parties involved; and not placing any emphasis on technical frameworks. The law includes 12 articles which stipulate the scope of application of the Model Law on Electronic Signatures, the definition and equal treatment of signatory technologies, compliance with the requirements of signatures, acts of signatories, verification of the behavior and trustworthiness of service providers, reliance on parties Behavior, recognition of foreign certificates and electronic signatures, etc.
