MTV收费风波引发的著作权问题较多,其中之一即为如何界定录像制品与电影作品。本文认为,从法理而言,录像应属于视听作品的形式之一,但我国将之规定为录像制品,具有实用性,可避免对表演者保护不力的尴尬局面。法律规定录像制作者享有出租权与信息网络传播权,而没有将集出租与信息网络传播的部分特点于一身的放映权加以规定,录像制作者的权利难以真正得到保护。
There are many copyright issues caused by MTV charging controversy, one of which is how to define video products and movie works. This paper argues that from the perspective of jurisprudence, video should belong to one of the forms of audiovisual works, but our country has defined it as a videotape product, which is practical and avoids the awkward situation of protecting the performers ineffectively. The law stipulates that videographers should enjoy the right to lease and the right to broadcast information without stipulating the right of projection which sets part of the characteristics of renting and information network transmission. Therefore, the rights of video producers can hardly be truly protected.
