案情原告温哥华社区学院(Vancouver Community College)是加拿大一所成立已久的公立学校,其学校简称为首字母缩写“VCC”。“VCC”和“Vancouver Community College”都已被温哥华社区学院依照加拿大商标法第9(1)(n)(iii)条进行注册,属于“官方标志”。被告温哥华职业学院(Vancouver Career College)从2009年左右开始在宣传其教育服务的广告中大规模使用“VCC”和“VANCOUVER COMMUNITY COLLOGE”这两个标志,其中包括在Google、Yahoo!及其他搜索引擎中的广告标题及正文内容
The Plaintiff Vancouver Community College is a long-established public school in Canada, abbreviated as acronym “VCC”. Both VCC and Vancouver Community College have been registered by the Vancouver Community College under section 9 (1) (n) (iii) of the Canadian Trade Marks Act and are “official symbols.” The defendant, Vancouver Career College, has made significant use of the “VCC” and “VANCOUVER COMMUNITY COLLOGE” signs in advertisements promoting education services around 2009, including Google, Yahoo! And other search engines advertising title and body content
