在我国矿产资源开发利用过程中,存在明显的权利与权力的冲突。物权对矿产资源的轻视与忽略以及行政权在矿产资源领域的膨胀与扩张,是导致该冲突形成的主要原因。为有效协调该冲突,必须要以明确矿产资源的财产属性为基础,对在矿产资源开发利用中存在的问题进行类型化分析,并明确区分国家作为矿产资源所有者和管理者的不同身份,从而逐步厘清民事权利和行政权力在矿产资源开发利用过程中的各自分工与侧重。
