现代社会是风险社会,高度发达的现代性中的各种原因导致风险具有弥漫性、渗透性和公共性特征,从而也使得风险规制摆脱了个人话语而成为社会和政府共同的任务。在公共交通领域,在保障公民基本权利的立宪主义原则的指导下,政府应在风险预防、风险现实发生后的规制方面发挥积极作用,进而促使风险规制的法治化。同时,还应防范风险规制过程中产生的伴随风险、附加风险。
Modern society is a risk society, and various reasons in the highly developed modernity lead to diffuse, pervasive and public risk characteristics of risk, thus making risk regulation out of personal discourse and becoming the common task of society and government. In the field of public transport, under the guidance of the principle of constitutionalism that guarantees the basic rights of citizens, the government should play an active role in the regulation of risk prevention and risk reality, and then promote the legalization of risk regulation. In the meantime, we should also guard against the attendant risks and additional risks arising from the process of risk regulation.
