《内地与香港关于建立更紧密经贸关系的安排》(CEPA)是以“一国两制”原则为基础,并基于中国内地与香港均属世界贸易组织(WTO)成员,因而必须遵守WTO有关自由贸易区的规则这一特点,互利互惠的区域性贸易自由化安排。尽管CEPA本身没有对该安排中的知识产权保护作出任何规定,但是,正如WTO作为促进全球贸易自由化的体制安排,必然涉及知识产权保护,在实施CEPA中也不可避免地会遇到各种知识产权保护问题。翻本文将从内地与香港知识关权制度的比较角度,略论与CEPA有关的若干主要知识产权问题。
The Mainland and Hong Kong Closer Economic Partnership Arrangement (CEPA) is based on the principle of “one country, two systems” and based on the fact that the mainland of China and Hong Kong are members of the World Trade Organization (WTO), they must abide by the WTO rules on free trade Regional rules of this feature, mutually beneficial regional trade liberalization arrangements. Although CEPA itself does not make any provision for the protection of intellectual property rights in this arrangement, just as WTO, as an institutional arrangement to promote global trade liberalization, necessarily involves the protection of intellectual property, it inevitably encounters all kinds of knowledge in the implementation of CEPA Property protection issues. This article will be from the perspective of the Mainland and Hong Kong’s system of intellectual property rights comparison, on a number of major issues related to CEPA intellectual property.
