海峡两岸警察行政处分救济制度在受理处分救济的机构设置、行政处分的司法救济、行政处分救济的程序及警察行政处分的救济种类等方面均存在不同。我国大陆地区警察行政处分救济制度应当通过引入听证程序保障,部分处分可提起司法审查程序,成立一个独立的第三方处分救济机构及建立专门的警察行政处分救济制度等方式予以完善。
There are differences between the two sides of the Taiwan Strait police administrative sanctions relief system in accepting the establishment of relief agencies, the judicial relief of administrative sanctions, the procedures of administrative sanctions relief and the kinds of remedies for police administrative sanctions. The police administrative sanctions relief system in mainland China should be improved through the introduction of hearing procedures, partial sanctions may be brought to judicial review procedures, the establishment of an independent third-party relief agencies and the establishment of a special police administrative sanctions relief system and so on.
