多數國家的法學界都將商法看作一個獨立的法律部門。法學院開設的商法課程或者商法研究學者也是將商法視為一個獨立的學科加以講授或者研究。但對一個國家的法律體系而言,商法能否成為該法律體系中的一個獨立法律部門則取決於該國的法律傳統。
The legal profession in most countries views commercial law as an independent legal department. Commercial law courses or law scholars in commercial law also teach or study commercial law as a separate subject. However, whether a commercial law can be an independent legal department in a legal system of a country depends on the legal tradition of that country.
