死刑的废除是人类文明发展的必然,但现阶段我国尚不具备全面废除死刑的条件,因而在司法中限制死刑(立即执行)的适用是我国当前最为可行的道路。现阶段我国可在司法中逐步确立死刑的法官穷尽救济原则,通过扩大死缓的适用范围来严格限制死刑的司法适用,进而为全面立法废除死刑创造条件。
The abolition of the death penalty is an inevitable result of the development of human civilization. However, at this stage, China still does not have the conditions for abolishing the death penalty in full. Therefore, the application of the death penalty (immediate execution) in the judiciary is the most feasible way in our country at present. At this stage, China can gradually establish the principle of exhaustion of relief for judges in the judiciary and strictly limit the judicial application of death penalty by expanding the scope of application of death penalty, thus creating the conditions for abolishing the death penalty for comprehensive legislation.
