《国家赔偿法》的颁布,标志着我国对公民权的保护的重视,它的修订推动了我国的法制进步,确立精神损害赔偿制度是符合现代法治和时代发展要求的。本文从我国建立精神损害国家赔偿制度的可行性和实践原则两个方面进行论证,对完善我国国家赔偿法中精神损害赔偿展开了思考。
The promulgation of “State Compensation Law” marks our country’s emphasis on the protection of citizen’s rights. Its revision has promoted the progress of the legal system in our country and the establishment of the system of compensation for mental damages is in line with the requirements of the modern law and the requirements of the development of the times. This article argues from the feasibility and the principle of practice of establishing state compensation system for mental damage in our country and ponders over how to improve the compensation for mental damage in the state compensation law of our country.
