罪犯由于被剥夺人身自由,其权利容易受到监狱部门的侵害。监狱部门的行为是行政行为,现今世界各国普遍允许罪犯权利缺损时向法院提起行政诉讼。本文指出为了法制建设的需要,我们应该在中国建立司法行政诉讼救济的基本范围包括绝大部分监狱执行刑罚行为,但不包括抽象行政行为。我们还应确立两个立法原则,即明确行政救济前置原则和充分保障律师参与原则。
As criminals are deprived of their liberty, their rights are vulnerable to prison administration. The behavior of the prison department is an administrative act. Nowadays all countries in the world generally allow administrative proceedings to be brought to the court when the rights of the criminal are absent. This article points out that for the needs of legal construction, we should establish the basic scope of remedy for judicial administrative proceedings in China, including the execution of criminal penalties in most prisons, but excluding abstract administrative acts. We should also establish two legislative principles, that is, define the pre-principle of administrative remedies and fully guarantee the principle of lawyers participation.
