经济法的发展事关法律体系的结构调整和制度变迁,需要与宪法等各个部门法的发展相协调。“经济宪法”为经济法的发展提供了重要的宪法基础,发展经济法既是宪法规范的要求,又是实施宪法的需要,同时,经济法的发展也有助于宪法的完善和发展。基于经济法与宪法所共有的经济性和规范性,应通过司法判断和非司法判断,不断提升两者的一致性和协调性,全面促进其协调发展。
The development of economic law is related to the structural adjustment and institutional change of the legal system, which needs to be coordinated with the development of the various department laws such as the Constitution. The Economic Constitution provides an important constitutional foundation for the development of economic law. The development of economic law is both a requirement of constitutional norms and a requirement of implementing the Constitution. At the same time, the development of economic law is also conducive to the perfection and development of the Constitution. Based on the common economic and normative nature of the economic law and the constitution, judgments and non-judicial judgments should be adopted to continuously improve the consistency and coordination between the two and comprehensively promote their coordinated development.
